Terms of Service

These Terms of Service govern your access to and use of the HighGravityData website, member portal, reports, and related digital services operated by HighGravityData LLC under the HighGravityData and HGD brands.

By visiting the site, creating an account, purchasing a membership, or using any part of the service, you agree to these Terms and any additional policies or notices that apply to specific features. If you do not agree, do not use the service.

You may use HGD only if you can form a binding agreement under applicable law and are not barred from using the service under any applicable law or regulation.

You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and all activity that occurs under your account.

• Membership access is personal to the subscriber and may not be shared with any other person.
• You must notify us promptly at support@highgravitydata.com if you believe your account has been compromised or used without authorization.

HGD may offer multiple membership levels, including Free, Explorer, Pro, and additional tiers introduced later. Access to reports, archives, and decision-support materials depends on the tier associated with your account.

Free-tier access may include selected starter content and limited protected materials. Paid tiers may include broader weekly and monthly coverage, larger universes, deeper portfolio decision support, and other features described on the pricing page.

We may modify, expand, or retire features within a tier from time to time. The current scope of each tier is described on the site and may change as the service evolves.

HGD operates on a paid subscription model, and certain features require a paid membership, including Explorer and Pro.

Paid subscriptions are billed on a recurring monthly basis.

Subscriptions automatically renew at the end of each billing period unless cancelled prior to renewal.

Users may cancel their subscription at any time. Cancellation will take effect at the end of the current billing period, and access will continue until that time.

All payments are non-refundable unless otherwise stated.

Access to certain features and content depends on the user's active subscription tier.

HighGravityData LLC reserves the right to modify, update, or discontinue features, content, or pricing at any time.

All HGD content is provided for informational and educational purposes only. HighGravityData LLC does not provide investment, legal, tax, accounting, or financial advice.

Nothing on the site, in reports, or in any HGD content should be interpreted as a recommendation to buy, sell, hold, or allocate to any asset, security, strategy, or portfolio.

HGD makes no representation or warranty as to the accuracy, completeness, or reliability of any information provided, and no guarantee of performance or outcomes is made or implied.

Users remain solely responsible for their own decisions and actions.

Past performance is not indicative of future results.

HGD makes no guarantee of profitability, performance, outcomes, accuracy, completeness, timeliness, or suitability for any purpose.

Markets involve risk, and past observations, historical analysis, model outputs, or prior performance do not guarantee future results. Use of the service may result in losses, missed opportunities, or decisions you later disagree with.

The service, including all reports, research, text, graphics, layouts, branding, and other content, is owned by or licensed to HighGravityData LLC and is protected by intellectual property and other applicable laws.

Your membership gives you a limited, personal, non-exclusive, non-transferable, revocable right to access the service for your own internal use, subject to these Terms.

• You may not copy, redistribute, resell, republish, publicly display, transmit, or share HGD reports, research, or site content without prior written permission.
• You may not post protected content to social platforms, shared drives, forums, messaging groups, or public websites.
• You may not use HGD content to create competing products, datasets, models, or commercial offerings without written permission.

You agree not to misuse the service or interfere with its operation.

• Bypassing access controls, entitlement checks, account restrictions, or technical protections.
• Sharing accounts, scraping content, or systematically extracting data except as expressly permitted by HGD.
• Attempting to reverse engineer, probe, or test the service for vulnerabilities without authorization.
• Using the service in violation of applicable law, regulation, or third-party rights.

We may suspend, restrict, or terminate your access if we believe you have violated these Terms, failed to pay required fees, created risk for the service or other users, or used the service in an unlawful, abusive, or harmful manner.

You may stop using the service at any time. Suspension or termination does not affect obligations that accrued before the suspension or termination date.

The service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.

HighGravityData LLC disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, availability, security, and accuracy.

To the fullest extent permitted by law, HighGravityData LLC and its affiliates, officers, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the service.

To the fullest extent permitted by law, HighGravityData LLC's total liability for any claim arising out of or relating to the service or these Terms will not exceed the amount you paid to HGD for the service during the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars (US$100), whichever is greater.

You agree to defend, indemnify, and hold harmless HighGravityData LLC and its affiliates, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or related to your misuse of the service, your violation of these Terms, or your violation of any law or third-party rights.

We may modify, suspend, or discontinue any part of the service at any time. We may also update these Terms from time to time as the service, memberships, or business operations evolve.

When we make material changes, we may update the date above and may provide additional notice through the site, your account, or email. Your continued use of the service after updated Terms become effective constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in Arizona, unless applicable law requires otherwise.
